Band A — the entry-level outcome

Band A covers speeds broadly within 10 mph of the enforcement threshold. In a 30 zone, that means 35–42 mph. The driver will typically be offered either a speed awareness course (around £80–£100, no points, not available if you attended one in the previous 3 years) or a Fixed Penalty Notice of £100 plus 3 points. It is the most common outcome and the one most drivers are familiar with.

Band B — where bans begin

Band B is where the nature of the penalty changes. The fine rises to 100% of weekly income and magistrates must choose between 4–6 penalty points or a short driving ban. There is no Fixed Penalty option — this goes to court. In a 30 zone, Band B starts at 43 mph. That is a speed most drivers reach without intent on a clear urban road.

Band C — the serious tier

Band C applies when speed exceeds the limit by more than 20 mph above the enforcement threshold. In a 30 zone: 51 mph. On a motorway: 101 mph. The starting fine is 150% of weekly income — up to £1,000 on most roads and £2,500 on a motorway. Magistrates can also impose a ban of 7–56 days. Six points from a single Band C conviction puts a driver halfway to the totting-up threshold.

⚠️ The £100 fine is only one possible outcome — and not the worst one. Drivers who assume any speeding offence ends in a £100 fine are unaware of Bands B and C. The gap between 42 mph and 43 mph in a 30 zone is the difference between a fixed penalty and a court summons with an income-based fine and a potential ban.

20 mph zones and what they do to the bands

The rapid spread of 20 mph zones — including Wales's introduction of 20 mph as the default speed limit in built-up areas in September 2023 — has compressed the bands significantly. In a 20 mph zone:

A driver who misses a 20 mph sign and continues at 35 mph is in Band B territory — facing court, an income-based fine, and 4–6 points or a short ban. Intelligent Speed Assistance (ISA) — what new cars now have

From July 2024, Intelligent Speed Assistance became mandatory on all new vehicles type-approved for sale in the EU. Cruise control is widely used on motorways and dual carriageways to maintain a steady speed and reduce driver fatigue. It works well for that purpose — but it has no awareness of speed limit changes, and that gap is where prosecutions happen.

The risk is highest at transition points: a national speed limit road entering a village, a dual carriageway dropping to 40 through roadworks, a 40 zone becoming a 30. The car holds the speed it was set at. The driver, comfortable and distracted by the absence of active throttle control, misses the sign. The limit has changed; the cruise control has not.

Average speed cameras in roadworks are particularly unforgiving in this scenario. There is no single point at which you are caught — the system measures your average over the entire section. A driver who enters a 50 mph roadworks zone on cruise set to 65 and only notices the gantry halfway through will have already generated an offence regardless of what speed they finish at.

On unfamiliar routes especially, treat any gantry sign, village boundary, or roadworks warning as a prompt to check your set speed — not just your actual speed.

What to do if you receive a Notice of Intended Prosecution

If you are caught by a camera, the process begins not on the road but in your letterbox. Within 14 days of the alleged offence, the registered keeper of the vehicle must receive a Notice of Intended Prosecution (NIP) accompanied by a Section 172 notice — a legal requirement to identify who was driving.

Protecting your licence: the totting-up threshold

Accumulating 12 or more penalty points within any 3-year period triggers a minimum 6-month disqualification — regardless of whether any single offence warranted a ban. The 3-year window is measured from the date of each offence, not conviction. A driver with 9 existing points who picks up 3 more from an apparently minor Band A offence will face a totting-up hearing.

New drivers face a harsher threshold. Under the Road Traffic (New Drivers) Act 1995, accumulating 6 or more points within the first two years of passing your test causes automatic licence revocation. You revert to learner status and must retake both theory and practical tests. Two speeding fixed penalties in two years — 3 points each — is enough.
